Please read these Terms carefully. By downloading, installing, or using any Ziza application or service, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

1. Parties and Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Ziza LLC, a limited liability company incorporated in the State of New Jersey, United States ("Ziza," "we," "us," or "our").

By accessing or using the Ziza platform — including the Ziza Customer app, Ziza Driver app, Ziza Craft app, and related websites (collectively, the "Services") — you confirm that you are at least 18 years old, have the legal capacity to enter into a binding contract, and agree to these Terms.

2. Description of Services

Ziza provides a technology platform that connects:

  • Riders seeking on-demand transportation services in New Jersey;
  • Driver Partners who provide transportation services as independent contractors;
  • Professionals offering roadside assistance and vehicle maintenance services ("Ziza Craft").

Ziza is a technology intermediary only. We do not provide transportation or roadside assistance services directly. Driver Partners and Professionals are independent contractors, not employees or agents of Ziza.

3. User Accounts

To use the Services, you must create an account. You agree to:

  • Provide accurate, complete, and current registration information;
  • Maintain the security and confidentiality of your credentials;
  • Notify Ziza immediately of any unauthorized use of your account;
  • Accept responsibility for all activities conducted through your account.

Ziza reserves the right to suspend or terminate any account at its discretion if these Terms are violated or if fraudulent activity is detected.

4. Rider Terms

When you book a ride through the Ziza platform, you agree that:

  • You will pay all applicable fares, fees, and charges as displayed in the app before booking;
  • Ziza uses dynamic pricing — fares may vary based on demand, time, distance, and vehicle category;
  • You will treat Driver Partners and their vehicles with respect;
  • You will not engage in any unlawful, dangerous, or harassing behavior during a trip;
  • You are responsible for any damage caused to a Driver Partner's vehicle during your trip.

5. Driver Partner Terms

Driver Partners using the Ziza platform agree that:

  • They are independent contractors, not employees, agents, or partners of Ziza;
  • They hold a valid driver's license, vehicle registration, and insurance as required by New Jersey law;
  • All submitted KYC (Know Your Customer) documents must be authentic and accurate;
  • They will comply with all applicable traffic laws and regulations;
  • Ziza reserves the right to deactivate a Driver Partner's account for violations of these Terms, unsafe driving reports, or low ratings.

6. Ziza Craft (Professional) Terms

Professionals offering services through Ziza Craft agree that:

  • They hold all licenses, certifications, and insurance required to perform the offered services in New Jersey;
  • All bids submitted are binding upon acceptance by a Customer;
  • They will arrive within the stated ETA and perform services as described;
  • Ziza is not liable for the quality, safety, or outcome of services rendered by Professionals.

7. Payments and Fees

All payments on the Ziza platform are processed in US Dollars (USD). By providing a payment method, you authorize Ziza or its payment processors to charge applicable amounts.

  • Riders: Charged the fare displayed at the time of booking. Cancellation fees may apply.
  • Driver Partners: Earnings are calculated after Ziza's service fee. Payments are made weekly via bank transfer.
  • Professionals: Earnings from accepted bids are disbursed weekly after deduction of Ziza's platform fee.

All fees are non-refundable except where required by applicable law or expressly stated in our Refund Policy.

8. Ratings and Reviews

Users may rate Driver Partners and Professionals after each completed service. Ratings must be honest and based on actual experience. Ziza reserves the right to remove ratings that are fraudulent, abusive, or violate our Community Guidelines.

Driver Partners and Professionals with consistently low ratings may be suspended or removed from the platform.

9. Prohibited Conduct

You agree not to:

  • Use the Services for any illegal purpose or in violation of any law;
  • Harass, threaten, or discriminate against other users;
  • Submit false documents, fake reviews, or fraudulent trip/service requests;
  • Attempt to reverse-engineer, scrape, or interfere with the Ziza platform;
  • Create multiple accounts or use another person's account;
  • Use the Services while under the influence of alcohol or drugs (Driver Partners).

10. Intellectual Property

All content, trademarks, logos, and technology on the Ziza platform are the exclusive property of Ziza LLC or its licensors. You are granted a limited, non-exclusive, revocable license to use the Services for their intended purpose. No rights are transferred to you.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ZIZA DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

ZIZA MAKES NO REPRESENTATIONS ABOUT THE CONDUCT, QUALITY, OR SUITABILITY OF ANY DRIVER PARTNER OR PROFESSIONAL ON THE PLATFORM.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZIZA LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICES.

ZIZA'S TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO ZIZA IN THE THREE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

13. Indemnification

You agree to indemnify, defend, and hold harmless Ziza LLC, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively by binding arbitration administered in Newark, New Jersey, in accordance with the rules of the American Arbitration Association (AAA), except that either party may seek injunctive relief in any court of competent jurisdiction.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Changes to These Terms

Ziza reserves the right to modify these Terms at any time. We will provide notice of material changes via the app or by email. Continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.

16. Termination

Ziza may suspend or terminate your access to the Services at any time, with or without cause or notice. Upon termination, all licenses granted to you cease immediately. Provisions that by their nature should survive termination (including payment obligations, indemnification, and limitation of liability) shall survive.
